Laura Rewards Program Terms & Conditions
Loyalty Program Overview
- 1. Effective as of October 19th, 2015 (the “Program Start Date”), the Laura Loyalty Program (referred to as the “Program” or the “Laura Style Rewards Program”) came into effect. The Program is a customer loyalty program offered by Laura, a division of Laura’s Shoppe (P.V.). Inc. (also known as Laura Canada), to customers of participating Laura stores (the “Stores” or each individually a “Store”). The following terms and conditions govern the Program.
- 2. Laura may, in its sole discretion, restrict, suspend, amend, extend or otherwise alter the terms and conditions relating to the Program (including earning and redemption rates) at any time, from time to time, and without prior notice. If the terms and conditions have been updated, Laura will post the new terms and conditions on the Laura website found at www.laura.ca and on the Melanie Lyne website found at www.melanielyne.com (the “Websites”) and note the date that they were last updated. We encourage Members (as defined below) to review the terms and conditions relating to the Program each time they visit the Laura website and/or shop at Laura and/or Melanie Lyne. Notwithstanding the foregoing, Laura may, in its sole discretion, terminate all or any part of the Program at any time with 30 days’ prior notice.
- 3. Where notice is to be provided pursuant to any section of these terms and conditions, it will be made via notices posted in Stores and/or a notice posted on the Website, as determined by Laura in its sole discretion.
- 4. Registering in the Laura Database: To participate in the Program, an individual must be registered in the Laura or Melanie Lyne customer database. In order to become a member of the Program (each, a “Program Member” or “Member”), an individual must quality for membership (“Program Membership”) in the manner set out below.
- New customers can enroll into the Laura database at any participating Store or online, and an account (“Account”) will automatically be set up for their purchases to be tallied towards Program eligibility as of their registration date.
- Only one Laura database record or Program Membership is available per customer. Only an individual customer may become a Program Member. If any additional family members or others domiciled with a Member wish to participate in the Program, they must each register for their own personal Account.
- Account balances (purchases) may not be combined or transferred for the purpose of eligibility in the Program and/or for the purposes of earning Style Rewards. Only the registered holder of each Account is eligible to earn a Style Reward from that Account.
- Individuals who wish to opt-out of the Program may do so by calling Customer Service toll-free at 1 877 973-6090 ext. 7780.
- 5. Qualifying for Laura Style Rewards Insider Membership: After registering in the Laura or Melanie Lyne database, customers will become eligible for the entry level tier Program Membership with no minimum spend. Once they become Members, customers will be eligible to receive loyalty benefits and earn Style Rewards.
- Qualifying for Laura Style Rewards Luxe Membership: Members who spend between $900 and $1,799 (before taxes and after returns) on eligible merchandise, at participating Stores, in a 12-month period, will automatically advance to the Luxe Rewards level and receive additional Luxe benefits and also be eligible to earn Style Rewards.
- Qualifying for Laura Style Rewards Elite Membership: Members who spend $1,800 or more (before taxes and after returns) on eligible merchandise, at participating Stores, in a 12-month period, will automatically advance to the Elite Rewards level and receive additional Elite benefits and also be eligible to earn Style Rewards.
- Program Members are entitled to receive either Insider Rewards, Luxe Rewards or Elite Rewards level benefits for 12 months from the month in which the Member qualified for the Insider Rewards, Luxe or Elite Levels.
- Eligible merchandise includes any merchandise purchased at a Participating Store with the exception of Laura gift cards. A Member’s purchase tally includes purchases made with a Laura gift card at a participating Store.
- Program membership is granted in Laura’s sole discretion, and may be withdrawn or suspended in Laura’s sole discretion with or without notice and without liability to Laura. See Rule 7 for more information.
Re-qualification for Style Rewards benefits
- 6. During the 12-month membership period, Members will automatically requalify for Insider Rewards. Members must re-qualify to the Luxe Rewards tier by spending between $900 and $1,799 (before taxes and after returns) on eligible merchandise, in participating Stores, to receive Luxe Rewards benefits for another year, or a minimum of $1,800 (before taxes and after returns) to receive Elite Rewards benefits for another year. If a Luxe or Elite Member does not re-qualify, she will re-qualify at the Laura Style Rewards Insider level.
- If a Member does not re-qualify at either Luxe or Elite, the Program benefits and eligibility for Luxe and Elite benefits will be suspended until the customer has re-qualified. The customer will continue to be an Insider member until she requalifies to Luxe or Elite tiers.
- Example: A customer who qualifies as an Elite Rewards tier with a membership start date of January 1, 2023 by spending a minimum of $1800 (before taxes and after returns) on eligible merchandise, in participating Stores, will receive loyalty benefits and be eligible to earn Style Rewards until December 31, 2023. During this 12-month membership period, the Member must re-qualify by spending a minimum of $1800 (before taxes and after returns) on eligible merchandise, in participating Stores to continue receiving loyalty benefits and be eligible to earn Style Rewards beginning January 1, 2024. If they do not requalify, they will either drop to Luxe Rewards, if the member has spent between $900 and $1799 (before taxes and after returns) on eligible merchandise, in participating Stores, or the Insider Rewards level if they have spent under $900.
- 7. If Laura determines that a Program Member has abused any of the Program’s privileges and benefits, fails to comply with any of these terms and conditions, or makes any misrepresentation to Laura, Laura may, in its sole discretion, take such actions as it deems appropriate, including without limitation, suspending such Member’s privileges and benefits under the Program, revoking any or all of the Style Rewards earned in such Member’s Account, and/or revoking Membership in the Program, in each case, with or without advance notice to the Member and without liability to Laura.
- 8. Many of the Program benefits are delivered by direct mail and/or email. Program Members must advise Laura immediately of any change to their mailing address or by calling Customer Service at 1 877 973-6090 ext. 7780, or by going online at www.laura.ca / www.melanielyne.com or by visiting a participating Store.
Earning Style Rewards
- 9. Style Rewards can be earned by a Member in connection with eligible purchases made at Laura or Melanie Lyne stores or online at laura.ca or melanielyne.com, provided that the customer is identified as the Member at the time of purchase. The Style Reward will be earned in the Account associated with the Member. A Member’s purchase tally includes purchases made with a Laura gift card. Exclusions: Purchases are not tallied and rewards are not earned on purchases of Laura gift cards.
- 10. Style Rewards earned are not transferable or assignable. Program Members may not combine Style Rewards in their Account with those in Accounts held by other Members. Style Rewards accrued cannot be inherited through the will of a deceased member or otherwise assigned or transferred in any way.
Issuance of Style Rewards
- 11. Style Rewards will be automatically mailed or emailed two months following the month in which Members earn their Style Reward. Style Rewards are tallied based on the Member’s purchases of eligible merchandise (before taxes and net of returns) made at participating Stores during the applicable 12-month period).
- Purchases of Laura gift cards are excluded (see Rule 9).
Style Rewards are subject to the following Terms and Conditions:
- A Style Reward is valid from the date of issuance indicated on the reward, until the expiry date indicated.
- The Style Reward may be redeemed only by the person whose name appears on it, and is not transferable. A personal photo ID may be requested upon redemption.
- A Style Reward may be redeemed only at participating Stores.
- A Style Reward may not be used for the purchase of Laura gift cards.
- A Style Reward can be redeemed during its validity until the entire balance has been used.
- If the full amount of the Style Reward is not used in a single transaction, the balance will carry over until the expiry date.
- The Style Reward has no cash redemption value.
- If an item purchased with a Style Reward is returned, a refund will be issued for the amount paid by the customer and the Style Reward amount will be credited. The original expiration date of the Style Reward will apply to the credited amount.
Privacy Notice
- 12. Laura collects your personal information such as your name, address, telephone number, birth date, email address and purchase information when you register in our database at a participating Store. When you provide Laura with your personal information, we inform you as to why we are collecting it and obtain your verbal consent. In some instances, where the purpose of collection is obvious and the law permits, your consent is implied.
- When you register in the Laura database and/or become a Member, Laura only uses your personal information for the purposes of providing you with information concerning its business, products, services and promotions, as well as marketing and administering the Program. Your personal information is not shared with other companies or disclosed to any third parties, except for the purposes stated herein or as permitted or required by law. Laura strives to ensure that our security measures protect against loss, theft and unauthorized access of your personal information.
- You can withdraw your consent for the use of your personal information at any time by contacting Customer Service at 1 877 973-6090 ext. 7780. Opting out will cancel your participation in the Program, however a Laura customer can still choose to receive marketing information and communications not related to the program.
Acceptance of Terms and Conditions
- 13. By registering in the Laura database, each Member or potential Member (i) certifies that she is over the age of majority in the province in which he or she resides (or is supervised by a parent or legal guardian who agrees to these terms and conditions on behalf of the Member), (ii) consents to Laura’s collection, use and disclosure of certain personal information as set out in Laura’s privacy policy available at https://laura.ca/pages/privacy-policy or https://melanielyne.com/pages/terms-of-use and (iii) agrees to the terms and conditions of the Laura Style Rewards Program, as they may be amended from time to time.
Miscellaneous
- 14. Except as specifically outlined herein, these terms and conditions represent the only agreement between the Member and Laura in connection with the Laura Style Rewards Program and supersedes all prior agreements, understandings, negotiations and discussions, whether oral or written. There are no representations, warranties, covenants, conditions or other agreements, express or implied, collateral, statutory or otherwise, including implied warranties or conditions of merchantability or fitness for a particular purpose, between a Member and Laura in connection with the Program, except as specifically set forth in these terms and conditions. If any provision in these terms and conditions is determined to be illegal, invalid or unenforceable, that provision will be severed and the remaining provisions shall remain in full force and effect.
- These terms and conditions shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein, and all Members attorn to the exclusive jurisdiction of the courts of the Province of Quebec. Any proceedings relating to matters regarding the Laura Style Rewards Program shall be brought exclusively in the courts of the District of Montreal in the Province of Quebec and orders of such Quebec courts shall be binding on Laura and Program Members. Otherwise, all decisions regarding the interpretation of these terms and conditions and the administration of the Laura Style Rewards Program, and any disputes arising there from, shall be resolved by Laura in its sole discretion. All such decisions shall be final and binding on all Program Members. In no event shall Laura’s liability with respect to the Loyalty Program, including liability for negligence or breach of contract, be greater than the Style Reward accumulated in such Member’s Account at the time the dispute arose.
- 15. Employees, representatives and agents of Laura’s Shoppe (P.V.). Inc. are eligible to participate in the Laura Style Rewards Program, to earn and redeem any Style Rewards.
